Welcome to **Callofia** (the "Platform"). These terms define our legal relationship, outline platform responsibilities, and protect the network integrity. Please read carefully.
In Plain English
We only provide the software and tech platform connecting landlords with guests. We are not real estate agents, brokers, or property inspectors. Your rental contracts are purely between host and guest.
1 Scope of Callofia's Services
1.1 The Platform's Role: Callofia is a digital real estate management tool and a high-trust, zero-commission peer-to-peer rental marketplace. We provide the technology that allows property owners, managers, or hosts ("Hosts") to publish, manage, and promote accommodation listings, and allows guests ("Guests") to view and request bookings.
1.2 No Agency or Brokerage Status: Callofia is not a real estate broker, rental agent, insurer, or travel agency. We do not own, manage, operate, control, or inspect any of the properties listed on the Platform. We do not act as an agent for any User.
1.3 Independent Transactions: Any agreement or contract for the rental of a property is entered into directly and exclusively between the Host and the Guest. Callofia is not a party to, nor is it responsible for, any contractual relationships, obligations, or disputes arising from transactions between Users.

You must be 18+ to use Callofia. Your credentials are your responsibility. We don't guarantee the identities of guests or hosts, so please perform your own screening.
2 Platform Access and User Accounts
2.1 Eligibility: You must be at least 18 years old and possess the legal capacity to enter into binding contracts to register an account. By registering, you warrant that you meet these requirements.
2.2 Account Accuracy: You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.
2.3 Verification Disclaimer: While Callofia may implement safety features or basic profile verification, we do not verify the identity of any User, nor do we guarantee the safety, quality, legality, or suitability of any listed property. Users are encouraged to exercise due diligence.

Hosts must post accurate info. Hosts are fully responsible for complying with Moroccan laws, registering guests with local police (Gendarmerie/Sûreté Nationale), and declaring taxes.
3 Host Obligations and Compliance
3.1 Listing Accuracy: Hosts are solely responsible for ensuring that all property descriptions, pricing, availability calendars, house rules, and images listed are accurate, complete, and not misleading.
3.2 Legal Compliance in Morocco: Hosts represent and warrant that they possess all legal rights, titles, and authorizations required to list and rent out the properties. Hosts are solely responsible for complying with all applicable Moroccan laws and regulations, including but not limited to:
- Law No. 80-14: relating to tourist establishments and other forms of tourist accommodation.
- Local security registrations: Obligatory reporting of guest identities to the local police (Sûreté Nationale) or Royal Gendarmerie (Gendarmerie Royale) where required.
- Tax obligations: Declaration and payment of any rental income taxes, tourist taxes (Taxe de Séjour), or other applicable municipal taxes.

Because we are commission-free and do not process transactions, we do not touch the rental money. Therefore, we literally cannot process refunds or cancellations. All payments and disputes are handled directly between the Host and the Guest.
4 Financial Model, Payments, and Refund Disclaimers
4.1 Zero-Commission Model
Callofia operates primarily on a zero-commission model for rental bookings. We do not charge transaction commissions or service fees on individual bookings between Hosts and Guests.
- Off-Platform Transactions: Hosts and Guests arrange, agree upon, and execute payments directly between themselves (e.g., bank transfer, cash on arrival, external mobile wallet).
- No Escrow: Callofia does not act as an escrow agent, payment processor, or financial intermediary for rental transactions.
4.2 Absolute Liability Shield for Refunds

No Refund Liability: Because Callofia does not collect, hold, or process payments for rental bookings, Callofia has absolutely zero liability, obligation, or technical capability to issue refunds, chargebacks, or compensation to Guests or Hosts for any booking transaction.

Direct Resolution: Any request for refunds, cancellations, security deposit returns, or financial compensation must be settled directly between the Guest and the Host in accordance with the Host's specified cancellation and refund policy.

Exclusion of Disputes: You explicitly release Callofia from any claims, demands, damages (actual and consequential), or disputes of every kind and nature arising out of or in any way connected to payment disputes or refunds.
4.3 Platform Subscription Fees (SaaS)
Software Fees: If you subscribe to Callofia's premium property management features, premium listings, or advanced software plans ("Subscription Services"), you agree to pay the fees set forth at the time of subscription.
Subscription Refund Policy: All subscription fees paid to Callofia for premium software access are strictly non-refundable, except as required under applicable Moroccan consumer protection law (Law 31-08) where a statutory right of withdrawal might apply within designated cooling-off periods.

We offer our app "as-is". We are not responsible if anything happens at a property (accidents, damage, etc.). If we are legally found liable, our total liability is strictly capped at what you paid us in subscription fees in the past year.
5 Limitation of Liability
To the maximum extent permitted by applicable law (including the Moroccan Dahir des Obligations et des Contrats):
5.1 "As Is" Basis: The Platform and all content are provided "as is" and "as available" without any warranties of any kind, whether express or implied. We do not warrant that the Platform will operate uninterrupted, error-free, or free from viruses or other harmful components.
5.2 Exclusion of Damages: In no event shall Callofia, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data.
- Property damage, personal injury, bodily harm, or emotional distress arising out of or in connection with any stay, booking, or interactions with other Users.
- The conduct, actions, or omissions of any Host, Guest, or third party.
5.3 Maximum Liability Cap: In the event that Callofia is found liable for any claim despite the above exclusions, our total aggregate liability to you for any cause whatsoever shall be strictly limited to the total amount of subscription fees paid by you to Callofia in the twelve (12) months preceding the event giving rise to the liability.

If you break the rules or get into trouble with local authorities, hosts, or guests, you agree to cover Callofia's legal fees and expenses.
6 Indemnification
You agree to release, defend, indemnify, and hold Callofia harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected with:
- Your breach of these Terms.
- Your improper use of the Platform or Services.
- Your interaction with any User, including but not limited to any injuries, losses, or damages of any kind arising in connection with or as a result of a booking or stay.
- Your violation of any local laws, tax duties, or third-party rights (including intellectual property or privacy rights).

All designs, code, assets, and branding on Callofia belong exclusively to us. No copying or scraping of listings without permission.
7 Intellectual Property
All software, user interface design, logos, brand elements, graphics, and text on the Platform are the exclusive property of Callofia or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform strictly for personal or internal business operations in accordance with these Terms. You must not copy, modify, distribute, scrape, or reverse engineer any part of the Platform.

We can ban or suspend users who act fraudulently, break local Moroccan laws, ignore payments, or receive constant complaints from others in the community.
8 Termination and Suspending Accounts
Callofia reserves the right, in its sole discretion, to temporarily suspend, permanently terminate, or restrict access to your account at any time, without prior notice or liability, for reasons including but not limited to:
- Violation of these Terms or house community guidelines.
- Repeated negative feedback or serious complaints from other Users.
- Fraudulent, deceptive, or illegal activities.
- Failure to pay applicable Platform subscription fees.
Upon termination, your right to use the Services will immediately cease.

Moroccan law governs these terms. We agree to resolve any issues peacefully first. If that fails, any legal disputes must go to the Commercial Court of Casablanca.
9 Governing Law and Dispute Resolution
9.1 Governing Law: These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the Kingdom of Morocco.
9.2 Amicable Settlement: In the event of any dispute arising between the User and Callofia, both parties agree to first attempt to resolve the dispute amicably by contacting each other in writing.
9.3 Jurisdiction: If an amicable resolution is not reached within thirty (30) days of notification, the dispute shall be submitted to the exclusive jurisdiction of the Tribunal de Commerce of Casablanca (Commercial Court of Casablanca), Morocco.

We can update these terms at any time. Continuing to use Callofia after updates means you agree to the new terms.
10 Modifications to the Terms
We reserve the right to modify these Terms at any time. When we make changes, we will post the revised Terms on the Platform and update the "Last Updated" date at the top.
Your continued use of the Platform after the effective date of any modifications constitutes your unconditional acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Platform and close your account.
